The SAPA article’s totally fail to mention the reasons the Justice’s gave for their decision to reduce the Reits Four sentences, which Volkblad did mention:
Judge Rampai said in the Appeal Judgement that the Magistrate did not distinguish between the personal circumstances of the accused. The Magistrate also sentenced them as if they had committed crimen injuria against black people in general, and particularly the students and staff of the University of the Free State. The Magistrate approached his sentencing on a faulty foundation. The accused only admitted guilt against the five plaintiffs.

Judge Rampai also said that he is convinced that the script in the video that looks as if one of the four students urinated into the food, was simply acting, and that no urination had really occurred.

Furthermore he is convinced that the four women cleaners and the man were acting in the video, and that they did not digest the food, and were simply acting as if they were vomiting.

The importance hereof is that the moral blame of the criminal conduct of the accused is reduced. The seriousness of the insult to their dignity was really nowhere as great and upsetting as it was perceived and thought to be.

He said the Magistrate made conscious misstatements about the nature and seriousness of the crime at sentencing.
