Respondents Memorandum of Fact and Law (PDF:1963K) -- or as referred to by The Star below “Huntley's Affidavit” -- is the response from the Respondent (Huntley) legal representatives (Russel Kaplan and Rocco Galati), to the Minister of Citizenship and Immigration: Mr. Jason Kenney's Application for Review: Memorandum (WwAwR Response).
Minister Kenney's Application for Review, was launched in response to the politically correct International Political and Media outrage to the 'White Refugee IRB ruling', by and on behalf of, the South African Goverment, to the 27 August 2009 ruling of Immigration and Refugee Board Member, Mr. William Davis, in favour of Huntley's Convention Refugee Status.
Huntley's Memorandum states the grounds for justification that the Application for Review be denied, in that the Min. Kenney's Application for Review is an abuse of process; is politically motivated on the part of both the Canadian and South African goverments; and would never have been applied for, had it not been for the pressure placed on the Canadian Goverment, by the South African goverment, et al.
Huntley's Memorandum of Fact and Law (PDF)is supported by the following Affidavits:
- Affidavit of Stefanie Gude, an assistant to Mr. Rocco Galati. Mr. Rocco Galati, appears to be the solicitor representing Mr. Huntley, as Respondent, in this Review Application Matter.
- Affidavit of Amina Sherazee, a Barrister and Solicitor, practicing exclusively in Immigration and Refugee Law, who (i) confirms the veracity of Ms. Gude's Affidavit; and (ii) states, among others; the Canadian Goverment would never have made any application for Review; but was pressured to do so, as a result of the public democratic threats made, and the accusations of 'racism', from the South African Goverment.

Brandon Huntley's lawyers have slammed a Canadian government attempt to overturn his crime refugee status as driven by pressure from South Africa and "based on misguided politically correct notions".
And they have further dismissed Canada's bid to challenge the decision granting 31-year-old Huntley refugee status based on his race as an "abuse of process" and "politically abusive application" which was founded on "alarm (at) the potential opening of (white) flood gates from South Africa".

Huntley's lawyers slam refugee challenge

Brandon Huntley's lawyers have slammed a Canadian government bid to overturn his crime refugee status as driven by pressure from South Africa and 'based on misguided politically correct notions', according to a Johannesburg newspaper report.
They have also dismissed Canada's bid to challenge the decision granting 31-year-old Huntley refugee status based on his race as an "abuse of process" and a "politically abusive application" founded on concerns about open floodgates to white South Africans.
Canadian Immigration Minister Jason Kenney wants the country's Federal Court to review Immigration and Refugee Board chairman William Davis's decision, and then to send Huntley's case back to the board for rehearing.
Huntley was granted refugee status after claiming he was being persecuted by "African South Africans".
His lawyers insist that seven attacks on him were because he is white.
The lawyers argue Kenney would not have tried to challenge Davis's decision if it were not for the "racist allegation driven pressure" of the South African government.
