Oscar Pistorius Father - Henke Pistorius - says his son needed guns to protect himself, because the ANC fail to curb violent crime, particularly against whites and farmers. South Africa's crime rate is among the highest in the world with 15,000 people murdered last year, with an estimated 1,600 (cited by Telegraph) vs over 4,000 (Censorbugbear stats) murders of white farmers since 1990. Telegraph Reporter Ainslin Laing does not mention the numerous reports of Police cooking crime statistics, to pretend that crime has decreased.

Ishmael Mnisi, an ANC spokesman, said Mr Pistorius' comments were "worrying", and that massive crime does not justify citizens owning guns, they should report crime to the police.

Meanwhile the Independent Police Investigative Directorate (IPID) has revealed a report that about 932 people died in police custody in South Africa in 2011/12.

A controversial police general headed the crime intelligence unit’s dirty tricks campaign to plant evidence and evesdrop on the Boeremag treason accused and their lawyers, a former officer claims in sworn statement.

The statement claims General Mark Hankel specially flew to America to purchase the bugging devices which were used to unlawfully monitor the conversations between the accused and their legal teams. The revelations of Deon Loots, a former captain in the crime intelligence unit, about the alleged police conspiracy to frame the Boeremag plotters were first broken by Media24 Investigations on October 7. But Loots’ affidavit – which he has confirmed – goes further and names individual officers which he charges are at the centre of the conspiracy. His statements are separately supported by other affidavits by former officers which are in the possession of a Pretoria attorney.

If his claims are true it could lead to the Boeremag trial – the longest, at nine years, in South African history and which cost more than R100m – being declared a mistrial. Loots, who made his statement in August, has investigated the Boeremag for years and was also the handler of the main agent who infiltrated the organisation.

Constitutional expert Prof Pierre de Vos said Loots’ allegations could result in the trial being declared null and void and having to be heard from scratch again. Twenty Boeremag members were found guilty of high treason in July and August. The trial will re-commence in January next year when they could be sentenced to life behind bars.

Hankel made news headlines last year when he headed the crime intelligence unit for a short while after Lt-Gen Richard Mdluli was suspended. Mdluli appointed family members as senior officers in the unit and bought luxury vehicles for himself with money from the secret fund, according to statements by investigators.

It has also been reported that in 2002 Hankel failed two polygraph tests for his security clearance. He denies it. This was during the period when Hankel headed the investigation of the Boeremag project. Loots was married to an officer who also worked on the right wing investigation and who was Hankel’s right-hand. In his statement Loots identified a number of police officers whom he claimed worked under Hankel and were responsible for manipulating the investigation. “The Boeremag was driven, managed, orchestrated and all the planning had been done by these [crime intelligence] members,” said Loots. He said he had been extremely upset by the “provocation role” played by the police. “Innocent people had been inflamed, used and compromised. I had nowhere to complain as the top structure of police intelligence drove and managed these things,” Loots said. Loots said evidence had been fabricated by crime intelligence in order to “make things look much worse.” He said police officers told their agent to organise right-wing meetings. They were instructed what to say at the meetings which would inflame Boeremag members. “I told Hankel continuously that they were busy inciting a crime hoping to involve innocent people. This was laughed away. They were obsessed with the idea to involve as many right wingers as possible,” Loots charged.

Loots said the police wanted to know what was discussed between the accused and their legal teams, so that they could counter the defence. He claimed Hankel flew to America to buy the latest in phone hacking and video equipment. This was allegedly planted in the cells of the accused. Similar equipment was also planted in the consultation rooms where the accused consulted with their legal teams, he claimed. Loots said the visual and audio recordings were beamed to the crime intelligence head office in Erasmuskloof where a so-called “war room” had been established which contained monitors and loudspeakers.

“I personally from time to time watched videos of the accused in their cells. Hankel and others made jokes and laughed. From the start the trial was never fair,” said Loots. He claimed none of the witnesses for the prosecution ever drew up their own statements and that police wrote them so that they corroborated each other. “Thereafter it was returned to the witnesses for it to be signed. They (the witnesses) had to learn it off by heard like parrots,” he said.

Hankel this week said that he was not allowed to talk to the media. The police’s national spokesperson, Colonel Tummi Shai, undertook to respond to the allegations but at the time of going to press she had not responded. The police also undertook to respond to the allegations aired in Rapport last week and did not reply then either.

Czech fugitive Radovan Krejcir arrived in SA four years ago and set up a network involving strip club owners, gold and diamond dealers, hoodlums and top cops until, that is, the body count started to rise.

O’Sullivan claims that at least five people who were murdered are linked to Krejcir and the Jackie Selebi corruption trial. He said the murders started with the death of Kevin Trytsman in 2009.

“Uwe Gemballa who was murdered in February 2010, then we had Lolly Jackson who was murdered in May 2010, then we have Chris Kouremetis who was murdered in September or October 2010 [and] then we had Cyril Beeka…” O’Sullivan said.

Trytsman was a self-styled Umkhonto we Sizwe agent who stored weapons and vehicles for the ANC in the 1980s. He was arrested in November 1990 for possession of illegal weapons and stolen vehicles and later granted amnesty by the TRC. In November 1999 his company, South African Investigation Service Group, was contracted without a tender by then deputy minister of environmental affairs and tourism Rejoice Mabudafhasi to investigate allegations of corruption in the fishing industry and earned a fee of R558000 for 31 days’ work.

Allegations of bribery, threats of violence and unconstitutional decisions by leaders about who can vote lie in the wake of the recent conference in which deputy minister of international relations Marius Fransman was chosen as African National Congress (ANC) chairperson in the Western Cape.

Two affidavits in the possession of the Mail & Guardian claim Fransman's supporters tried to bribe delegates to persuade them to vote for candidates who would support him at the regional conference or to vote for him at the provincial conference from February 11 to February 13 in Cape Town.

According to one affidavit, date-stamped February 8 by the South African Police Service, a delegate at the West Coast regional conference in Clanwilliam was asked to "make his price" for his vote.

ANC delegate and branch chairperson Johannes Snyders, who is a school janitor in Eendekuil outside Piketberg, says in his one-page affidavit that two delegates who supported Fransman offered him money for his vote.

"On Saturday, January 4 at about 18h00, I was in Clanwilliam. We were approached and told that we must say what amount of money we want in order for us to side with them."

Thank you for the honour this invitation constitutes. It stirred many feelings in me. The first was doubt as to how your Society took that decision. I say this because I know the way my own profession takes decisions. This is best exemplified by the decision of the Johannesburg Bar Council some 40 years ago.

A well-regarded but cantankerous judge was hospitalised. A delegation was despatched by the Bar Council to his hospital bedside. The leader cleared his throat and told the judge that the Johannesburg Bar Council had mandated him to convey two messages. The first was that he was asked to wish the judge on behalf of the Johannesburg Bar a speedy recovery. The second was to tell the judge that this was on a vote of six to five.

My second feeling was one of nostalgia: nostalgia for those who taught me here, and who either as teachers or as fellow students became my friends for life; and those who taught me, or with whom I worked, in my own postgraduate life. Allow me to mention JC de Wet, Willem Joubert and Tony Honoré - now in his 62nd year of teaching at Oxford.

I and many of my colleagues in practice owe an inexpressible debt to you and to your predecessors. It concerns me that often law teachers seem to doubt the worth of what they do. Their task is ancient and vital. As CP Snow writes of Cambridge in his elegaic novel about university ambition, The Masters, it "[i]s hard not to think of other men walking as we did, of the chain of lives going back so long a time, of others walking those same narrow streets in the rain".

That is not to say that law teachers at times lack brutality. I remember Sir Rupert Cross, great writer and teacher on the law of evidence, handing back collections (essays) at Oxford and saying: "I know you can't help your laziness, but you should really try to do something about your stupidity".

When you invite a practitioner to speak, you should know that his own scholarship will not have been sustained by the bits of writing and lecturing which only earlier years at the Bar readily allowed. So I do not venture a scholarly theme.

On the other hand, if you expect me to speak about things that matter to the profession, I shall do so, but only in part. For what I want to talk about today is a common malaise: a lack of critical faculty not merely in the Faculty, but across the face of legal life in South Africa. My thesis is that, for all lawyers, there are disturbing developments about which we are insufficiently articulate and active.

I have often thought that the trouble with political revolution, velvet or otherwise, is that it gives rise to the same illusions as university graduation. There is the sense of attainment and finality, of a status achieved and no more to be learnt or done. I believe the converse is true. It is just a beginning. That is true of the commencement of constitutionalism in 1994.

Two of the country's top experts on constitutional law are in disagreement the state of the justice system and especially the constitutional court.

Adv. Jeremy Gauntlett SC, who has been a judge in Cape Town, has kickstarted the debate with a speech (The Silence of the Lawyers) at a conference of the Association of Law Teachers in Stellenbosch.

Jeremy was called to the Bar in 1974 (commencing practice in 1977) and took silk in 1989. He became a member of Group 621 in 1999.

Jeremy is also a member of Brick Court Chambers in London, a barrister of England and Wales, an advocate of the High Courts of Lesotho, Namibia and Zimbabwe, and a Judge of Appeal of Lesotho.

He has contributed three titles to the Law of South Africa and has written a number of journal articles.

Jeremy was President of the Cape Bar in the years 1997 to 1999, and Chairman of the General Council of the Bar in the years 1999 to 2002. He is a member of the South African Law Commission and of the Council of the University of Cape Town.

Gauntlett did not walk on egg shells and said the time has come to put an end to the approach that aparthy is the appropriate response to analysis of court decisions and how courts operate.

A new study has found that police involvement in serious and violent crime is not limited to “isolated incidents” but a general pattern of behaviour that is common across the country.

Researchers say the 100 cases they examined are just “the tip of the iceberg” and they highlight ­alleged police involvement in ­serious crimes such as ATM bombings and house robberies, among others.

The research was conducted last year by the Unit for Risk Analysis at the South African Institute of Race Relations (SAIRR) and is due for ­release tomorrow.

The researchers studied media ­reports and gathered information from the Independent Complaints Directorate (ICD). Within one week 100 cases of alleged police involvement in serious and ­violent crime were found.

The cases did not include petty crimes, poor service delivery or officials soliciting small bribes.

Three quarters of the cases studied took place between January 2009 and April last year.

They were not an indication of the total number of allegations against police officers or convictions of police officers for involvement in serious and violent crimes over the period.

“We have bumped into the tip of an iceberg of violent and criminal behaviour in the ranks of the police which needs to be aired in public,” says deputy chief executive at the SAIRR, Frans Cronjé.

VIRGINIA. – Witnesses told the High Court about how a group, including a few policemen, planned the murder of a well known businessman and farmer from Wesselsbron and two police investigating officials, from the prison in Odendaalsrus.

They also testified about how different prisoners were told to go and draw blood in the place of others, in order for the murders to be arranged.

This occurred irrespective of the fact that one of the main witnesses for the state has dissapeared between Wednesday evening and Thursday morning, when he was required to testify.

Another testified how he was threatened in prison that he would be sodomized if he did not join the groups murder conspiracy, who are accused of conspiracy to murder Mr. Carel Marais and Insp. Nico Smith and Insp. Lizelle Herbst of the Hawks.

Mr. Lucas Kgobe, who was imprisoned on charges of rape, informed Judge S.P.B. Hancke how Insp. Japhta Kgothule (policeman brother of Free State arts and culture MEC Dan Kgothule), with whom he was imprisoned, was the spokesperson of the groups conspiracy.

He was approached by Mr. Godfrey Molefi (the witness who has since dissapeared) with information about “work” that Kghothule and his conspirators had for him. Molefi said that the work involved assassinating the complainant and the investigating officials in the accuseds case.

He was taken with Molefi to the other cell where Kgothule said he would make sure that Kgobe's bail was paid, so that they could get out to do the “work”.

Controversial regional magistrate Ronnie Rambau was arrested yet again over the past weekend, this time on a charge of conspiracy to commit murder.

Rambau’s arrest follows the discovery of a hit list compiled in his own handwriting. The list was handed to members of the police’s Counter Intelligence Unit for investigation.

Among the names on the hit list is that of district magistrate Chris Mthombeni, district magistrate Marie Viljoen, senior state prosecutor André Weideman, district prosecutor Reino Mostert, district prosecutor Hylke Janse van Rensburg, senior prosecutor Deon Laminga and three policemen, one a captain and two sergeants. All nine are involved in Rambau’s pending corruption case in Musina.

Two local witch doctors, who turned state witnesses, stated that they had already received payment from Rambau to murder the people on the list. The one told police that he had been paid R850 to kill all nine, while the other was paid R3 500.

The complainant in the case, whose identity is being withheld at this stage for her own safety, handed the list to the police, fearing the worst. In her police statement, she says Rambau repeatedly told her that his gun was not for shooting birds, but for shooting people who made him angry.

A warrant for Rambau’s arrest was issued on Friday (14th). Although he initially told police by telephone that he would hand himself over, police waited in vain outside his Louis Trichardt home. Rambau eluded police for several hours, but eventually surrendered himself at around 01:30 on Saturday.

My response to you addresses the following statements in your letter to Mr. Dewani. I would suggest that if you follow my recommendations, you are far more likely to provide Mr. Dewani with a free and fair trial, where you can find the honest answers to your questions:

We would ask you and your family to leave this case to the police and courts, rather than joining a media battle with your PR agents.

You state you're innocent of these allegations so please go back to Cape Town to prove to the South African police why they've got it wrong.

We have heard South African police give Tongo's version of events but we have yet to hear you publicly make clear your full explanation as to why he's lying.

We would like you to volunteer to go before a South African court and show how Tongo is lying. We believe that this would help the public understand the following questions:

* Why don't you voluntarily go to court and show South African police suspicions are wrong?

What we want is the truth to come out and justice to be served, which is possible only if you answer in front of South African Court of Justice.

If Anni had been murdered in any other country in the world, I might indeed agree with you that Mr. Dewani should return to South Africa to stand trial, where you would hear the truth. But Anni was murdered in South Africa, where our police and courts are that only in name, and where our government has been bullshitting the South African public and world with the most spectacular public relations TRC FRAUD publicity stunt.

The truth is that Shrien Dewani -- just like any and every other South African citizen -- stands 0% chance of a free and fair trial in South Africa. Introduction

At 2:10am on Christmas Day 1990, a gang of approximately twenty to twenty-five boys broke into the Salvation Army Girls Home in Killarney, Soweto. After attacking the night-watchman they broke the doors of the home and proceeded to make their way to the girls' dormitories. Brandishing an assortment of dangerous weapons, the boys threatened to kill the matron who they then stabbed with a sharp instrument. Amidst the turmoil and the panic, the boys selected their victims, who were then taken to various venues where they were raped.

For the first time the "Zebra Force"[1] became known beyond the confines of its immediate neighbourhood. Until then the gang was but a group of delinquent boys operating in the Meadowlands / Killarney area. This was one of the more conspicuously horrific forms of youth violence which aroused fear and revulsion in the people of the township. This was adolescent bravado run riot, but still it was one incident amongst many equally horrendous acts of violence committed in the township streets.[2]

There has been a rapid increase in the levels of violence in black communities like Soweto. It is arguable that the black "youth"[3] have been depicted as central protagonists in this tragic social drama.[4] A more popular tendency has been to speak of a "youth crisis" or "problem", and sometimes even a "lost generation". This approach fails to locate the structural and historical problems rooted in apartheid. On the other hand the political role of the youth has been covered extensively by academic writers[5] and it is no wonder that the youth have been identified as having been in the forefront in the making of South Africa's political history. These works, amongst others, have raised some major questions which have been placed on the agenda of the scholarly and social debates in recent years. Bundy, following Manheim,[6] attempts to provide an explanation for the role played by this generation of youth in the South African context. Like Hyslop,[7] he points out that the crisis of capitalism has led to disaffection and has spawned a fervent youth movement of the 1980s. The arguments go on to point out that the social conditions afflicting the youth were indeed the fuel behind the radicalism of the youth-based political movement. Hyslop in his study of the development of education policy and its political consequences, touches directly on the crisis of capitalism and its implications for the developing student movement.

South African politicians and businessmen who pocketed R1-billion from the arms deal are set to be named in a new investigation by Britain's auditing watchdog.

The Accountancy and Actuarial Discipline Board (AADB) is to investigate KPMG, which advised BAE Systems on offshore companies that were used to pay "commissions" to influence the awarding of lucrative contracts in South Africa's R47.4-billion defence procurement package.

Controversial businessman Fana Hlongwane, who was an adviser to then-defence minister Joe Modise when the arms deal was initiated, will be a key figure in the latest probe.

It follows an investigation in the UK and Liechtenstein into alleged payments of more than R200-million by BAE to him.

The company, which has also been under investigation by Britain's Serious Fraud Office (SFO) since 2007 for issuing bribes in South Africa, recently "settled" a £286-million fine for failing to comply with global anti-bribery rules.

The boardhas initiated the latest probe after corruption cases related to the arms deal were mysteriously dropped by South Africa's Hawks unit in September.

The audit, which will involve scrutiny of KPMG's confidential records, is set to reveal substantial financial evidence - and disclose the names of influential individuals - who, in exchange for cash, helped BAE supply Hawk trainer aircraft and Gripen fighter jets to South Africa for $2.1-billion.

The minister of police, national commissioner and divisional commissioner of crime intelligence of the Republic of South Africa have reportedly convinced the nation’s high court late Friday (29 Oct 2010) to stop the Sunday Independent newspaper from publishing information about dodgy appointments within the crime intelligence division, the periodical announced in a statement late Saturday (30 Oct 2010).

They added that it allegedly took the alleged biased Judge Ephriaim Makgoba “minutes” to rule on the application in the absence of the publication’s legal advisers. Under the censorship ruling the Sunday Independent has been gagged from publishing a follow-up story of alleged nepotism among top South African policemen, under the direct influence of the ruling African National Congress (ANC).

Reportedly the publication was ordered to submit all documents concerning the investigated police discrepancies and pay for the legal costs incurred. Ironically the South African Parliament has not yet passed its planned Protection of Information Bill or Media Censorship Bill, which is currently under discussion by a committee there. However it seems that the committee has not yet defined what “classified information” implies.

Rightwinger Willem Ratte has decided he will not apply for bail when he and nine other people return to court on preliminary weapons charges on Friday, his lawyer said on Monday.

"He is an angry man. He is not happy with the way that the State acted in this specific case. As far as he is concerned, they are keeping him in custody for no valid reason at all," said his attorney Daan Mostert.

He said it was possible that Ratte was trying to make a point with his decision.

Ratte and nine others made a brief appearance in the Witbank Magistrate's Court on Monday after being arrested during a police raid on his farm.

"Their case was postponed to Friday because some information about the accused still needs to ascertained," said National Prosecuting Authority spokesman Mthunzi Mhaga.

Mhaga said Ratte gave no reason to the prosecutors for his decision to abandon bail.

The preliminary charges were possession of dagga and unlicensed firearms.

The 10 were arrested in Balmoral, Mpumalanga, after police received information of a large number of arms and ammunition on Ratte's farm and that people were allegedly receiving military training there.

Corruption has become a “hobby” within the Tshwane Metro Police Department). This was revealed in a report by the Institute of Security Studies three years ago.

The report, “City Blues: Corruption and Corruption Management in South Africa’s Metropolitan Police Departments”, dates back to 2007, but nothing, sources in the department said, has changed in the past three years. Corruption remains a problem within the organisation, they said.

The Pretoria News and Eyewitness News in an investigation into alleged corruption within the city council revealed that more than 25 percent of metro police officials – including office-bound staff and those out on operations – were under investigation.

A total of 350 dockets have been opened by the Internal Investigations Unit against the department’s over 1 200 police members.

The report says the department is South Africa’s second largest metro police department with 1 914 employees, 1 220 of whom are police members.

The revelations come as the Independent Complaints Directorate is investigating the operations of an alleged organised crime syndicate within the department’s ranks.

The apparent criminal network, which uses State resources, sees members from the department’s Region 6 using strong arm tactics such as assaults, kidnappings and torture, to extort money from victims who include motorists, those using the services of prostitutes, and hawkers.

Cape Town - Ratepayers will end up paying for Cape Town stadium's operating costs after Sail Stadefrance walked out on a 30-year lease to manage the property.

"We do not have final numbers on what this will cost the ratepayer. In the end it will be up to the citizens of Cape Town on whether they come to the stadium to support the teams and events," the city's acting mayor Ian Neilson told reporters on Wednesday.

The city will take over management of the R4.4bn stadium.

Sail Stadefrance said it had projected "substantial losses" if it took up the project.

Sail Stadefrance Operating Company (SSOC) chief executive Morne du Plessis said "unresolved matters" affecting the viability of the lease, due to start on November 1, and "severe operating constraints" had caused the company to withdraw from the lease.

"The operating cost was surprising," he said.

"The maintenance costs were way above expectations.
